This Privacy Policy explains how we collect, use, share, and protect your personal data when you opt in to receive promotional SMS messages. When you consent to receive SMS marketing, we collect the following personal data: your full name; your mobile phone number in E.164 format; records of your consent, including the exact wording you saw, the timestamp, the source (such as Facebook Lead Form ID or website form), and, where available, your IP address or device identifier; and any optional information you choose to provide for personalization, such as areas of treatment interest.

We rely on your explicit consent to send you promotional SMS messages every two weeks. If you choose to receive appointment reminders via SMS, those messages are sent on the basis of contractual necessity if you have booked an appointment with us, or on the basis of your consent if those reminders are optional. We may also send you administrative communications, such as updates to our terms and conditions, based on our legitimate interests in maintaining our services and complying with legal obligations.

We obtain your consent through a separate, unticked checkbox on our lead-capture form that reads: “Yes – I consent to receive up to 1 promotional SMS every two weeks from Komao LTD (trading as ADS Medical). Standard network rates apply. Reply STOP to unsubscribe.” A link to this Privacy Policy and our SMS Terms & Conditions is provided immediately adjacent to that checkbox. Your consent is freely given, specific, informed, and unambiguous.

To facilitate SMS delivery and data processing, we share your personal data with selected third parties: Twilio, Inc. (our SMS gateway provider) and Zapier, Inc. (our automation platform), as well as their subprocessors. We have Data Processing Agreements in place with these vendors, and they rely on Standard Contractual Clauses and the UK Extension to the EU-US Data Privacy Framework for any transfers outside the UK/EU.

If your data is transferred outside the UK/EU, we ensure adequate safeguards by relying on the UK Extension to the EU-US Data Privacy Framework and/or Standard Contractual Clauses in accordance with UK GDPR requirements.

We retain your personal data for as long as you remain opted in to receive SMS marketing and no longer than 24 months after your last interaction, unless you request earlier deletion. Once you withdraw your consent or if our services end, we will securely delete or anonymize your data according to our retention schedule.

Under the UK GDPR, you have the right to access the personal data we hold about you, to request correction of any inaccurate or incomplete data, to request deletion of your data (“right to be forgotten”), to restrict our processing of your data, to receive your data in a structured, machine-readable format (data portability), to withdraw your consent at any time by replying STOP to any SMS or by contacting us at admin@ads-medical.com, to object to processing based on legitimate interests, and to lodge a complaint with the Information Commissioner’s Office (ICO) at https://ico.org.uk or by calling 0303 123 1113.

We have implemented appropriate technical and organisational measures to safeguard your data, including encryption in transit and at rest, role-based access controls and multi-factor authentication.

We may update this Privacy Policy from time to time. When we do, we will publish the revised version on our website with an updated “Last updated” date. If the changes are material, we will notify you via SMS or email.
